Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration. In addition to other terms as set forth in the Agreement, you are prohibited from using the Mobile Application or its Content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (e) to submit false or misleading information; (f) to collect or track the personal information of others; (g) for any obscene or immoral purpose. We reserve the right to terminate your use of the Service or any related mobile application for violating any of the prohibited uses.
The Services comprise mobile applications and related services (each, an "Application"), which enable users to arrange and schedule household repairs and/or technical services. The Services are made available solely for your personal, non-commercial use. YOU ACKNOWLEDGE THAT YOUR ABILITY TO OBTAIN HOUSEHOLD REPAIRS AND/OR TECHNICAL SERVICES THROUGH THE USE OF THE WEBSITE (http://fixup.lk/) OR THE FIXUP MOBILE APPLICATION (https://play.google.com/store/apps/details?id=lk.fixuplanka.fixup), DOES NOT ESTABLISH FIXUP AS A PROVIDER OF HOUSEHOLD REPAIRS AND/OR TECHNICAL SERVICES.
FixUp Mobile Application is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether expressed or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. To the extent permitted by law, FixUp will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website or the Mobile Application. In addition, FixUp makes no representation, warranty, or availability of the services or any timeliness, quality, suitability, or availability of the services or any services requested through the use of the services. FixUp does not guarantee the quality, suitability, safety or ability of third party providers. You agree that the entire risk arising out of your use of the services requested in connection therewith, remains solely with you, to the maximum extent permitted under applicable law. FixUp makes no warranty that the functionality of the Website or the Mobile Application will be uninterrupted or error free, that defects will be corrected or that the Website or the Mobile Application or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
a) User agrees to indemnify and hold harmless FixUp and its representatives from any claims, suits, losses, liabilities, damages and expenses, including reasonable attorneys' fees and court costs for the damage they cause.
b) User agrees to indemnify and hold harmless FixUp and its representatives from any Accidental Claims or suits though that occurs due to technician's/service provider's negligence or by fault of the technician/service provider. therefore Users agree to indemnify FixUp and its representatives from any type of vicarious liability.
c) Users accept that FixUp acts solely as a scheduling/matching service between its users and technicians/service providers, and that it is not responsible for any issues that arise during the service, such as accidents, delays, or property damages or uncomfortable experiences.
a) The Clients shall pay the repair/service charges (demanded by the technician/service provider) by Cash.
b) However if the user did not have sufficient amount to pay to the technician/service provider after the repair/maintenance/service is completed, FixUp will be indemnified from and against and in respect of any or all liabilities, losses, charges and expenses occurred to the technician/service provider.
c) If you have registered as a service provider, you are eligible for a 90 days free subscription period. After the free period, you agree to pay a monthly recurring subscription fee of Rs. 950 via eZ Cash, to continue working as a service provider.
The User can cancel the booking within 5 Minutes of the technician/service provider accepting the request, you won’t be charged. However if the cancellation of booking is done after 5 Minutes or if the Cancellation made after technician's/service provider's arrival for the location requested, there will be a Cancellation Charge.
We reserve the right to modify this Agreement or its policies relating to the Mobile Application or Services at any time, effective upon posting of an updated version of this Agreement in the Mobile Application. When we do we will post a notification in our Mobile Application. Continued use of the Mobile Application after any such changes shall constitute your consent to such changes.
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Mobile Application or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Mobile Application and its Services.
You agree that FixUp may contact you by telephone or text messages at any of the phone numbers provided by you or on your behalf in connection with a FiUp account, including for marketing purposes. You understand that you are not required to provide this consent as a condition of purchasing services. You also understand that you may opt out of receiving text messages from FixUp at any time, by requesting us via E-mail using the mobile device that is receiving the messages, or by calling FixUp customer support. If you do not choose to opt out, FixUp may contact you as outlined above.
